We are pleased to announce the opening session of our PhD2PhD Lunch Seminar Series. For this occasion, we warmly welcome Fien Van Reempts, PhD researcher at the University of Antwerp, who will give her presentation “The Effectiveness of Directives in Horizontal Situations: A Re-evaluation Post-Popławski II”.

  • Abstract

In Union law, the absence of the horizontal direct effect of directives has become a certainty akin to death and taxes. Less certain, however, is the extent to which directives can be effective in horizontal situations despite the lack of a (mandatory) horizontal direct effect, or which considerations should inform the scope of their effectiveness in disputes between private parties. Fien’s PhD research aims to uncover and (re-)evaluate the effectiveness of directives in horizontal situations in the aftermath of the Court’s landmark judgment in Popławski II on the scope of primacy and direct effect.
